No Transfer Duty or Capital Gain Tax?

demoFor those of you who have their primary residence registered in a CC., Trust or Company, now have the opportunity to transfer the property into your own name, with out paying transfer duty or capital gain tax. Before you take any action, consult with your finacial advisor to establish whether this will be to your advantage. Then consult with your transferring attorney to establish whether you will qualify not to pay transfer duty and capital gain tax. Then establish with your bank wheteher you will qualify for the outstanding bond amount. You have to take action before the end of 2011.

 

LANDLORDS: PACKAGE DEALS

    The Platinum Package (to Let and Manage plus)

    This package deal specifically caters for the Landlord who prefers to focus on his future investments while somebody else looks after his existing investments. This type of Landlord usually has more free time to spend with his family and for traveling.

    La Grande will;

    1) View and inspect the property with the intent to establish a fair market related rental for the property.

    2) Establish what repair/maintenance work will have to be attended to by the Landlord.

    3) Establish what additional amounts will be payable by the tenant, i.e. water, refuse, electricity, sewerage, garden services etc.

    4) Establish the monthly rental payable by the tenant.

    5) Obtain a written mandate from the Landlord.

    6) Contact the potential tenants on our waiting list and advice them of our new listing.

    7) If permitted, place a TO LET board outside the property.

    8) Take photos of property to market the property on websites.

    9) Arrange with present occupants when the property can be viewed.

    10) Personally escort potential tenants around the house.

    11) Carefully screen tenants to match Landlord’s requirements.

    12) Submit application forms to potential tenants.

    13) Once the completed application documents are received, scrutinize information on application form i.e. confirm that information on salary slip correspond with information on bank statement.

    14) Do a feasible study on whether potential tenant will be able to manage rental fees.

    15) Do a verification on potential tenant’s Identification Document.

    16) Do a credit check on potential tenant/s. (Trans union)

    17) Establish tenant’s rent payment behaviour. (TPN) (if recorded)

    18) Contact references.

    19) Once the potential tenant complies to La Grande’s and the Landlord’s requirements, a Lease Agreement between the Tenant and Landlord is drawn up.

    20) Scrutinize the Lease Agreement to ensure that the lease agreement complies with legal requirements.

    21) Obtain and attach a list of existing defects, to Lease Agreement.

    22) Obtain and attach a copy of any House Rules applicable to the property. This is important if the house forms part of Sectional Title or Home Owners Association.

    23) Make appointments to have the Lease Agreement signed by the parties concerned.

    24) Follow up with the tenant to have the Rental Deposit plus the first months Rent plus the Contract Fee, to be deposited into La Grande’s trust account.

    25) Once the above monies are received, the first months rent less contract and commission fees will be paid over into the Landlord’s bank account.

    26) As soon as the property is vacant and cleaned, an inspection will be carried out and an inventory will be drawn up by La Grande.

    27) On the day the keys are to be handed over to the tenant, an entry Inspection of the property will be carried out in the presence of the tenanat and the inventory of property goods will be checked/compiled in the presence of the tenant. (see paragraph (e) of the Rental Act.)

    28) After the monthly rental has been received from the tenant, the monthly rental minus La Grande’s commission fee, will be transferred into the Landlord’s bank account.

    29) Issue monthly invoices and statements to both the tenant and the Landlord.

    THE TASKS IN BLUE ARE ADDITIONAL TO THE ABOVE "GOLD PACKAGE"

    30) Verify the Landlord’s creditors i.e. utility accounts, and pay on the Lessor’s behalf as instructed in the mandate.

    31) Assize the situation regarding problems and issues such as late, partial or non payment from tenant and inform the tenant of the possible consequences thereof.

    32) In the event legal steps have to be taken against the tenant for not paying his rental or to obtain an eviction order, La Grande will advise and assist the Landlord and co-operate with the Landlords attorney, where possible. Although the legal costs will initially be for the Landlord’s account, these costs is to be claimed from the tenant. An attorney has to be consulted in this regard.

    33) La Grande will do an annual inspection of the property to ascertain the general condition of the property and to identify items that needs immediate or future attention.

    34) Act on behalf of Landlord regarding plumbing, electrical problems, obtain and submit quotations to Landlord and obtain Landlords approval for repair work to be done. In the event the Landlord cannot be contacted, and permission falls with in the scope of the mandate, La Grande will on behalf of the Landlord give permission to proceed with the repair work.

    35) Two months prior the lease expiry date, La Grande will approach both tenant and Landlord and if both parties wish to enter into a new Lease Agreement, La Grande will draw up the new Lease Agreement. The reason why a new lease agreement is preferred is that the Rental Act is being changed/adapted on a regular basis. Case law has shown that lease agreements have to be reviewed and updated on a regular basis. (as advised by attorneys specializing in this field)

    36) At the expiration of the Lease, La Grande will on behalf of the Landlord inspect the property in the presence of the tenant, three days prior vacation date, with a view to ascertain if there was any damage caused to the property during the tenant’s occupation thereof. (As per paragraph 3(f) of the Rental Housing Act)

    37) In the event the tenant ignores the request to have the property inspected as per the previous paragraph and has vacated the property, La Grande will on behalf of the Landlord inspect the property, with a view to ascertain if there was any damage caused to the property during the tenant’s occupation thereof. (As per paragraph 3(k) of the Rental Housing Act)

    38) In the event of damage caused to the property, La Grande will obtain quotations for the repairs to the property and after consultation with the Landlord, arrange for the repairs to be carried out. (Receipts for repairs will be obtained in order to comply with paragraph 3(h) of the Rental Housing Act)

    39) La Grande will on behalf of the Landlord refund the tenants deposit plus the interest earned on the deposit, minus costs for damage/repairs if any. (As applicable to paragraph 3(i) or 3(m) of the Rental Housing Act)
